Refer to the attached ohio state fire marshal - fire and explosion investigation bureau incident report for the "initial report". Note: this report was initiallly filed as "other incident cause" based on the investigation by the ohio state fire marshal. It was determined after further investigation by the public utilities commision of ohio (puco), that a supplemental report be submitted under "incorrect operations". It should be noted that when this incident occurred on november 2, 2010, a courtesy call was made to the puco hotline to inform them of the incident. Based on the information known at the time, puco staff instructed duke energy that this occurred on non-jurisdictional pipeline and was not reportable. After an on-site investigation meeting with various duke energy representatives and puco investigators on december 2, 2010, the puco staff instructed duke energy to file an incident report (initial report), after their conversation with PHMSA (pipeline and hazardous materials safety administration) staff. Duke energy relied on the ohio state fire marshal's incident report and used that as the explanation to the incident. After puco followed up with additional investigation of this incident, puco recommended by letter dated february 17, 2011, that duke energy submit a supplemental report to indicate the incident was caused due to "incorrect operations".
